This agreement outlines the terms and conditions under which Companion Services (‘Company’) provides non-medical companionship support to clients (‘Client’) for their healthcare appointments. By signing this form, the Client acknowledges, agrees, and consents to the following:
Scope of Services
Companion services are limited to non-medical assistance, companionship, and logistical support for patients during healthcare visits.
Our staff will not perform medical tasks such as administering medication, diagnosis, or any form of physical therapy or emergency treatment.
Services include accompanying the client to and from medical appointments, helping with registration, and facilitating communication with medical staff, as per the patient’s guidance.
No Medical Liability
Companion is not a healthcare provider and does not offer medical advice, treatment, or services.
Clients must consult qualified medical professionals for diagnosis or treatment.
The company will not be held responsible for any medical mishap, negligence by hospitals, delays in treatment, or outcomes of medical decisions.
Consent and Release
The client (or their authorized representative) consents to be accompanied by Companion’s field staff for the duration of the service.
Clients agree that the Companion team may collect and store non-sensitive service-related data (e.g., appointment times, feedback, service status).
Clients release Companion and its employees from liability for any incidental issues arising during the course of service, provided there is no gross negligence or misconduct.
Transportation Services
Vehicle services (if opted for) are operated either by our partnered transport vendors or field workers with their own verified vehicles.
The company assumes no liability for delays, accidents, injuries, or damages during transportation unless caused by gross negligence from Companion or its agents.
Confidentiality & Data Use
Companion will maintain confidentiality of all personal data collected.
Client agrees that certain non-sensitive data (such as feedback or anonymized service usage patterns) may be used for internal quality improvement.
Duty of Disclosure
Clients are expected to disclose any relevant medical condition (e.g., epilepsy, dementia, communicable diseases) that may affect the service delivery or require special attention.
Failure to provide such information may limit our ability to safely serve the client.
Restrictions on Use
Clients shall not misuse the services for unauthorized errands, personal work, or social visits not related to healthcare.
Clients are prohibited from making inappropriate personal requests to field workers, including financial, physical, or illegal demands.
Force Majeure
Companion is not liable for any failure or delay in service delivery due to natural disasters, strikes, pandemics, traffic disruptions, or other events beyond reasonable control.
Cancellation and Rescheduling
Cancellations must be made at least 4 hours before the scheduled appointment time. A late cancellation fee may apply.
In case of no-show by the client, Companion reserves the right to charge 50–100% of the service fee.
Safety and Conduct
Companion reserves the right to refuse or discontinue service if the client exhibits aggressive, abusive, intoxicated, or unsafe behavior.
Field workers are instructed to withdraw and report immediately in such cases.
Payment Terms
Payments must be made as per the selected service package or hourly usage rates.
Failure to make timely payment may result in suspension of services.
Limitation of Liability
Companion’s liability is limited to the value of the specific service rendered.
Under no circumstances shall the company be liable for indirect, incidental, or consequential damages, including but not limited to emotional distress, lost profits, or medical mishaps.
Indemnification
The client agrees to indemnify and hold harmless Companion, its officers, directors, employees, and agents from any claims, damages, or legal actions arising out of misuse of the service or violations of these terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
